Welcome to Thriving Minds Global. Please read these Terms of Service (Terms) carefully. They are a legal agreement between you (you, your) and Thriving Minds Global Pty Ltd, ACN 672 569 774 (TMG, we, our, us). They govern your use of our website and any services we offer through it. If you do not agree to these Terms, please do not use our website.

Acceptance
By using our website, or by booking or paying for a service through it, you agree to these Terms. You confirm that you are at least 18 years old, or that you have the consent of a parent or guardian, and that you have the authority to agree to these Terms, including on behalf of any organisation you represent.
Our website and services
Our website provides information about TMG and our leadership development services, including leadership coaching, learning and development, and retreats. Through the website you can learn about what we do, make an enquiry, and in some cases book and pay for a program, retreat, or coaching.
The website gives you general information. It is not professional advice, and you should not rely on it as advice for your situation.
Bookings and payments
Where we offer a service for booking or purchase through the website:
- prices are shown in Australian dollars and, where applicable, include GST
- payment is handled through a third-party payment provider, and we do not store your full card details
- your booking is confirmed when we accept it and you receive a confirmation from us, not simply when you submit a form or payment
- we may need to decline or cancel a booking, for example if a program is full or unavailable, and if we do we will refund any payment you have made for that booking
The specific service you book is also governed by the agreement for that engagement, such as our participant terms, service agreement, or coaching agreement. If anything in those documents differs from these Terms, the agreement for that engagement applies to that service.
Cancellations, changes, and refunds
If you need to cancel or change a booking, the cancellation terms for that program, retreat, or coaching engagement apply. We set those out at the time of booking or in the agreement for that engagement. Where those terms do not cover your situation, please contact us and we will deal with your request reasonably and in line with your rights under the Australian Consumer Law.
Your rights under the Australian Consumer Law
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms excludes, restricts, or changes any right or remedy you have under that law.
For services we supply that are not of a kind ordinarily acquired for personal, domestic, or household use, our liability for failing to meet a consumer guarantee is limited, to the extent the law allows, to resupplying the services or paying the cost of resupplying them.
Acceptable use
When you use our website, you agree not to:
- use it for any unlawful purpose, or in a way that breaches these Terms
- interfere with or disrupt the website or its security
- attempt to gain unauthorised access to any part of the website or its systems
- copy, reproduce, or republish our content except as these Terms allow

The content on our website, including text, images, logos, documents, and downloadable files, belongs to TMG or our licensors. You may view and use it for your own information. You may not copy, reproduce, distribute, or use it for any other purpose without our written permission.

Nothing in these Terms limits your rights under the Australian Consumer Law or any other right or remedy that cannot lawfully be excluded.
To the extent the law allows, and subject to the section on your rights under the Australian Consumer Law above:
- we provide our website and its content on an as-is basis, and we do not guarantee it will be uninterrupted, error free, or free of harmful components
- we are not liable for any indirect, special, or consequential loss arising from your use of our website
- our total liability to you in connection with the website is limited to resupplying the relevant service or paying the cost of resupply

Changes to these Terms
We may update these Terms from time to time to reflect changes in the law or in how we operate. We will post the updated Terms on our website and, where appropriate, let you know. The version on our website at the time you use it applies.
Governing law
These Terms are governed by the laws of the State of Queensland, Australia. You and we submit to the courts of that State.
Severability
If any part of these Terms is found to be invalid or unenforceable, that part is removed to the extent needed, and the rest of the Terms continue to apply.
